Background
I complained to my motorcycle dealer about why they registered my motorcycle to MOTORCYCLE WITH SIDECAR even if I told them several times that I have no plan to attach a sidecar. They told me that all Honda TMX125 are by default registered as MOTORCYCLE WITH SIDECAR as these units are used for business. I ask them if I will not get apprehended for using it without a sidecar. They answered me that apprehending officers will not apprehend me because it's private (okay to travel without a sidecar). What LTO/HPG officers apprehend are motorcycles with sidecars that are registered as MOTORCYCLE WITHOUT SIDECAR. Still, I am not pleased as I watched videos that other apprehending officers rely on what is declared in the OR/CR.
Steps Taken
To avoid problems in the future, I went to the Land Transportation Office at Barangay Sabang, Dasmariñas, Cavite, to ask how I can change my motorcycle type/denomination from MOTORCYCLE WITH SIDECAR to MOTORCYCLE WITHOUT SIDECAR. They asked me why, I explained to the officer that my dealer wrongly registered my motorcycle to MOTORCYCLE WITH SIDECAR should be MOTORCYCLE WITHOUT SIDECAR. The officer said, my dealer should process it for me. I informed the officer that my dealer is willing to process the change, but, on the day of my renewal of registration which is next year. I don't want to wait that long what if I will get apprehended, I will be paying a violation fee of PHP 5,000 which is a heavy fine for me.
Here the requirements:
- Get Affidavit of Change Body of Motorcycle
Note: The lawyer is not available within the LTO compound so I went to Dasmariñas Bayan to get the affidavit. I got my affidavit for PHP 300 at Dupal-ag Law Office, Notary and Realty Services located at #2 Second Floor LKC Building, Campos Ave, Zone 4, Dasmariñas, Cavite. - Photocopy of Affidavit of Change Body of Motorcycle
- Photocopy of 1 Valid I.D.
- Photocopy of OR and CR
- LTO officer advised me that I need to wait because they will submit my requirements to LTO Region via email for verification. LTO officer got my contact number so that they will contact me when I will return. The LTO officer told me not to forget to bring with me the original copies of the requirements I submitted.
